Riassunto: L’articolo di Caterina Villani intende mostrare come, per risolvere la “sfida dei concetti astratti”, all’ Embodied Cognition occorra concepire l’astrattezza da una prospettiva “multidimensionale”. Questo commento contiene due considerazioni. La prima riguarda il nesso logico tra la sfida dei concetti astratti e il cosiddetto “problema della generalizzazione”. La seconda discute alcune possibili tensioni dell’approccio multidimensionale stesso. The first modern edition of the Instituzione d’ogni stato lodevole delle donne cristiane (1575), and the Ricordi di Monsignor Agostino Valier Vescovo di Verona lasciati alle monache nella sua visitazione fatta l’anno del santissimo Giubileo 1575 (1575) by Cardinal Agostino Valier (Venice, 7 April 1531 – Rome, 23 May 1606). The Instituzione includes three texts meant respectively for unmarried women, widows, and married women (Del modo di vivere delle vergini che si chiamano demesse; Della vera e perfetta viduità; (...) Instruzione delle donne maritate), while the Ricordi is a book for nuns on monastic life. The texts by Agostino Valier are an important example of conduct literature for and about women in Counter-Reformation Italy. Contents include: a historical introduction to the author and his works; the Italian texts with notes; an index of names cited in the treatises; a bibliography. (shrink)

This book examines the most controversial issues concerning the use of pre-drafted clauses in fine print, which are usually included in consumer contracts and presented to consumers on a take-it-or-leave-it basis. By applying a multi-disciplinary approach that combines consumer's psychology and seller's drafting power in the logic of efficiency and good faith, the book provides a fresh and unconventional analysis of the existing literature, both theoretical and empirical. Moving from the unconscionability doctrine, it criticizes (and in some cases refutes) its (...) main conclusions based on criteria which are usually invoked to sustain the need for public intervention to protect consumers, and specifically related to Law (contract complexity), Psychology (consumer lack of sophistication criterion) and Economics (market structure criterion). It also analyzes the effects of different regulations, such as banning vexatious clauses or mandating disclosure clauses, showing that none of them protect consumers, but in fact prove to be harmful when consumers are more vulnerable, that is whenever sellers can exploit some degree of market power. In closing, the book combines these disparate aspects, arguing that the solution (if any) to the problem of consumer exploitation and market inefficiency associated with the use of contracts of adhesion in these contexts cannot be found in removing or prohibiting hidden clauses, but instead has to take into account the effects of these clauses on the contract as a whole. Nous abordons ici l’étude de la phénoménologie des objets visuels à partir de comptes rendus verbaux, de réponses à des questions ou de descriptions spontanées, ainsi que d’associations libres. Nous demandons même parfois aux sujets de réaliser de simples croquis. Cet éventail de méthodes permet de sonder la structure profonde de la conscience visuelle. Celle-ci est avant tout révélée par ce qui n’est pas spontanément mentionné par des qualités accidentelles ou encore par des changements induits lors de variations ou ajouts (...) mineurs. Nous avons trouvé une concordance remarquable parmi un grand nombre de participants. Ceci démonte que les comptes-rendus verbaux permettent d’explorer puissamment la structure de la conscience visuelle. Tout comme le langage, les « objets visuels simples » ont des racines profondes dans la conscience. Ces fondations « invisibles » servent à définir des figures simples, un « carré » par exemple, comme des objets prototypiques et uniques. La nature des « objets visuels » implique ainsi l’existence d’un « vaste domaine invisible ». Sans une telle prise en compte, la compréhension correcte de la nature de l’objet visuel n’est pas possible. Cette découverte devrait permettre de mener à une théorie de la syntaxe formelle des formes visuelles fondamentales. (shrink)

Summary Prägnanz was suggested by Max Wertheimer in the 1920s as subsuming all “Laws of Gestalt” as they apply to visual awareness. Thus, it assumes a prominent position in any account of Gestalt phenomena. From a phenomenological perspective, some visual stimuli evidently “have more Prägnanz” than others, so Prägnanz seems to be an intensive quality. Here, we investigate the intricacies that need to be faced on the way to a definition of formal scales. Such measures naturally depend both upon the (...) stimulus and upon the observer. Structural complexity bottlenecks of visual systems play a role, as well as the relevance to biological fitness, that is the affinity to the optical user interface. This positions the notion of Prägnanz squarely within the realm of biology. Indeed, the familiar “releasers” of ethology are singular cases of extremely high Prägnanz. (shrink)

This paper examines cognitive processes from an evolutionary, ecological and systemic perspective. Starting from Darwinian theory and the development of Extended Evolutionary Synthesis, the reference to evolutionary biology allows a rethinking of minds as complex phenomena "at the crossroads" between organisms and the environments they inhabit and contribute to build. It is proposed that this vision opens a space to overcome philosophical traditions that see in the minds "things" and in cognition a mirroring or representation of the world, to come (...) to an understanding of the former in terms of complex systems and to interpret the latter through the concept of "enaction". O estudo analisa a compatibilidade das relações especiais de sujeição com os direitos fundamentais, examinando, em especial, o alcance da restrição à liberdade de expressão dos agentes públicos militares prevista no artigo 166 do Código Penal Militar. Defender-se-á que tal limitação justifica-se apenas quando efetivamente prevalentes interesses institucionais ou públicos, reforçando, assim, o sistema hierárquico e disciplinar com vistas à salvaguarda da própria sociedade. Para tanto, invoca-se a necessidade de utilização das técnicas da proporcionalidade e ponderação na análise casuística. Michael Root argues, in Philosophy of Social Science, that social scientific investigations do not and cannot meet the liberal requirement of "neutrality" most familiar to social scientists in the form of Max Weber's requirement of value-freedom. He argues, moreover, that this is for "institutional," not idiosyncratic, reasons: methodological demands (e.g., of validity) impel social scientists to pass along into their "objective" investigations the values of the people, groups, and cultures they are studying. In this paper, I consider the implications of (...) Root's claims for the use of social scientific results in the formation of policy in a democratic society. In particular, I argue that Root's results amplify familiar "post-modernist" conclusions: there is no "neutral" and "objective" basis for policy-making. (shrink)

Being in a romantic relationship is characterized by a high degree of intimacy and affective involvement. Affective behavior indicates the emotional content in couple interactions and therefore promotes an understanding of the evolution of romantic relationships. When couples are also parents, their affective behavior reflects their romantic and coparental bonds. In this paper, we present an observation of parent couples’ affective behavior during a coparenting conflict discussion task to document whether and how much it improved during couple therapy. Two contrasting (...) cases of affective behavior change are included. Observational coding of affective behavior within pre- and post-intervention coparenting conflict discussion tasks was carried out to compute means and CIs for each partner in both cases. In addition, the partners’ coparental and romantic satisfaction were evaluated through validated self-report questionnaires in pre- and post-intervention assessments; this helped document whether the partners’ coparental and romantic satisfaction were dissimilar between the two cases. Finally, a clinical analysis of both cases was realized with the contribution of the therapists to investigate possible differences within therapy sessions. Statistical analyses revealed negative means of affective behavior for couple A in the pre-intervention assessment and positive means in the post-intervention assessment. Partners from couple B had negative means of affective behavior in the pre- and post-intervention assessments. Results concerning coparental and romantic satisfaction differed: Couple A’s coparental satisfaction slightly increased and the romantic satisfaction somewhat decreased, whereas couple B’s coparental satisfaction remained stable and the romantic satisfaction slightly increased between the pre- and post-intervention assessments. The clinical analysis revealed that the interactional quality of couple A slightly improved within therapy sessions and that both partners succeeded in working together as coparents, notwithstanding their romantic distress. Couple B conveyed coparental distress and exhibited poor interactional quality throughout therapy sessions (e.g., repeated criticism and contempt). This study contributes to enriching the more traditional empirical research methods in the field of couple psychotherapy, as it takes into account microlevel affective changes within parent couples’ interactions in addition to self-reported data. Furthermore, the analysis of therapy sessions supports the importance of working with affective behavior in couple therapy. (shrink)

Free Public Reason examines the idea of public justification, stressing its importance but also questioning the coherence of the concept itself. Although public justification is employed in the work of theorists such as John Rawls, Jeremy Waldron, Thomas Nagel, and others, it has received little attention on its own as a philosophical concept. In this book Fred D'Agostino shows that the concept is composed of various values, interests, and notions of the good, and that no ranking of these is (...) possible. The notion of public justification itself is thus shown to be contestable. In demonstrating this, D'Agostino undermines many current political theories that rely on this concept. Having broken down the foundations of public justification, D'Agostino then offers an alternative model of how a workable consensus on its meaning might be reached through the interactions of a community of interpreters or delegates at a constitutional convention. An astonishing thesis in the philosophy of quantum gravity is that spacetime ”disappears” at the fundamental level of reality, and that the geometrical notions of ”length” and ”duration” are derived from the dynamics of the basic non–geometrical building blocks of the theory. Unveiling here the analysis of the concepts of spacetime, measure, and magnitude, given by the philosopher Nicolai Hartmann, I argue that the ”disappearance” thesis is too strong. The fundamental geometrical notions are, on the contrary, primitive and cannot be (...) derived from the fundamental building blocks; they must be presupposed ab initio not only for epistemological, but also for methodological reasons.
